Case Studies
Challenge
A senior engineer with employment income, rental properties, and a side consulting practice had been filing a single Form BE annually, without accounting for her business income through the correct form. She also had no documentation for her home office expenses.
Solution
The team restructured her filing approach, transitioning her to Form B, properly accounting for all income streams and applicable deductions. A record-keeping framework was introduced to document business expenses going forward, along with a plan for rental income reporting.
Outcome
Her tax position was corrected across two years through voluntary disclosure. The engagement also identified reliefs she had not previously claimed, resulting in a lower assessed liability for the current year than the previous one.

Challenge
A mid-sized manufacturer in Shah Alam had expanded its plant significantly but had not assessed whether the capital expenditure qualified for investment tax allowance under the Promotion of Investments Act. Their effective tax rate was higher than necessary.
Solution
Bestari Legal reviewed the expansion documentation and capital expenditure records. The qualifying assets were identified and an ITA application was prepared for submission to MIDA. The team also reviewed the company's transfer pricing documentation covering intra-group raw material purchases.
Outcome
The ITA application was submitted within the allowable period and approved. The transfer pricing documentation was brought into line with IRBM guidelines ahead of the following assessment year, reducing exposure to potential adjustment.

Challenge
A Malaysian software company providing services to clients in Singapore, Australia, and the United Kingdom had not assessed its permanent establishment position in those countries. Management was uncertain whether its sales representatives based in Singapore triggered a PE.
Solution
Krishna reviewed the Singapore DTA and the activities of the local representatives in detail. An advisory memorandum was produced mapping the PE risk under the treaty's dependent agent provisions. Recommendations on restructuring the representative arrangements were provided.
Outcome
The company implemented revised contractual arrangements for its Singapore team that addressed the PE concern. The repatriation of software licence revenues was also restructured to align with the Malaysia-UK DTA withholding tax provisions, reducing the applicable rate.
